The Website Store, LLC - Terms and Conditions of Use and Service - Service Contract
Below are the Terms and Conditions, and Service Contract, for any services and/or any other work done by The Website Store, LLC (including subcontractors, employees, and affiliates, also referred to as simply "we", "our", or "us" herein).
1. Quotes / Estimates
Due to the nature of the work we do, all projects, large and small, will come with a quote or estimate. This quote or estimate may be in the form of a simple email, PDF file, webpage, or some other means.
Estimates are an approximation of cost. If further works needs to be done to complete your project, you will be notified with an updated estimate or quote.
You will need to accept the quote or estimate before any billable work will be done.
The time that quotes or estimates will be honored is at The Website Store, LLC's complete discretion.
Project Scope, Billing Terms, and a Completion Date will be indicated in the quote or estimate.
2. Project Scope
Outlined in the quote or estimate, the project scope describes the work to be done. We will try an explain what we will do as best we can. If you do not fully understand what you are going to pay for, please ask us to further explain. You will responsible for paying for completed work once you accept/agree to the quote or estimate.
3. Billing
Billing terms will be outlined in the quote or estimate. If no payment terms are outlined, then a monthly invoice will be sent at the beginning of each month to the client billing for hours worked the previous month.
We currently accept payment via check (made out to "The Website Store, LLC") or PayPal (sent to info@thewebsitestore.com).
4. Completion Date
A project completion date will be outlined in the quote or estimate.
Due to uncertainties, this is always an estimate. We will aim to complete the project by the completion date, but do not guarantee it.
5. Cancellation
If you decide to cancel your order/project before it is complete, you will be responsible to pay for any and all work done up to that point (billable hours, billable services, etc.) You will be given output from work done to that point at your request (example: the incomplete PHP script, etc.), as well as an itemized bill.
We may cancel any project before it is complete at our discretion. If this occurs, you will not be billed for that project. You will be given output from work done to that point at our discretion (example: the incomplete PHP script, etc.).
6. Discounts / Promotions / Refusal of Service
We may apply discounts, remove discounts (unless it is written into the current project's quote or estimate), honor promotions, and/or refuse any project at our discretion.
7. Domains and Hosting
If you have your own domain and/or hosting provider, we will need full access to the hosting account in order to apply work done (if applicable). We cannot guarantee that work we do will be compatible with your own hosting service.
If you need a domain name, you will need to purchase it yourself. We do not provide this service. However, we will gladly help you obtain one if you need. We suggest purchasing domain names through GoDaddy.com.
If you need hosting, you may either purchase the service yourself, or let us handle it. We will usually purchase your hosting account at Host Gator, and charge a monthly handling fee along with the hosting fee. It is cheaper, however, to sign up for Host Gator Hosting yourself at Hostgator.com. More information is available at http://www.thewebsitestore.com/hosting.html.
8. Maintenance
Maintenance, including (but not limited to) updates, revisions, and additions costs extra, and is billable at our standard hourly rate in 15 minute increments, unless otherwise agreed upon at our discretion.

9. Release of Liability
In no event will we (The Website Store, LLC) be liable to you (the client/customer), your business/company, and/or any third party for any damages, including (but not limited to) any lost profits, lost savings or other incidental, consequential or special damages arising out of the existence, non-existence, operation of, or inability to operate work completed by, or services by The Website Store, LLC.
In no event will we (The Website Store, LLC) be liable to you (the client/customer), your business/company, and/or any third party for any damages, including (but not limited to) any lost profits, lost savings or other incidental, consequential or special damages resulting from the work or services provided by The Website Store, LLC, even if we have been advised of the possibility of such damages.
The information and functionality of this website/domain (thewebsitestore.com) is provided as is, with no warranty or guarantee.
Work completed for you (the client/customer), your business/company, and/or any third party by The Website Store, LLC is provided as is, with no warranty or guarantee.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed sever-able from this agreement and shall not affect the validity and enforceability of any remaining provisions.
10. Copyrights and Trademarks
You (the client/customer), your business/company, and/or any third party providing elements of text, graphics, photos, designs, trademarks, or other artwork furnished to us for inclusion in your project unconditionally guarantees that any of said elements provided to us are owned by you and/or your company, or that you and/or your company has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend The Website Store, LLC from any claim or suit arising from the use of said elements.
Once the website or web project is complete, you (the client) own the works. However, you agree to allow The Website Store, LLC to use and/or reuse elements from the project (code, images, etc.) freely, such as reusing a background image from your project for the production of another website for another client.
11. Laws Affecting Electronic Commerce
From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. You and/or your business agree to retain full and sole responsibility for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend The Website Store, LLC from any claim, suit, penalty, tax, or tariff arising from your (and/or your businesses) exercise of Internet electronic commerce.
12. Contract Changes
This contract may change over time. You agree to be responsible for revisiting this contract and the terms and conditions herein before ordering new products or services.
13. Client Satisfaction
We will continue to work on your project, within the scope of the project outlined in the quote or estimate, until you (the client/customer) and/or your business/company is completely satisfied. Changes and updates are to be within reason, subject to The Website Store, LLC's complete discretion. Due to the nature of the work we do, and services we provide, The Website Store, LLC does not issue refunds.
14. Link Back and Portfolio
You agree to allow The Website Store, LLC to place at least one link in the footer content of your site linking back to a website of our choice (usually www.thewebsitestore.com).
You also agree to allow The Website Store, LLC to display the result of your project as a portfolio piece (and the like) as we see fit.
15. Future Projects
This contract applies to work done for all current and future projects.
By typing your name, verifying the date, and signing your name below (which acts as your authorized signature) you (on behalf of you and your organization/business/company) agree to have read and understand this contract, and fully accept the terms and conditions of this contract.
